M M r <br />Attorney Brandenburg pointed out that everyone has the same <br />opportunity, and Chairman Scurlock felt that after considering <br />all alternatives, this was the fairest one of all, and noted that <br />these problems would be considered at the workshops. <br />Commissioner Wodtke felt the vested issue was going to be <br />there in any event, and even though he certainly is not in favor <br />of moratoriums, we must face the issue, and he believed this is <br />the fairest direction to take. <br />Chairman Scurlock emphasized that it is not and never has <br />been the Commission's intent to reduce the densities in the Comp <br />Plan on the barrier island; however, it is their intent to <br />provide the necessary infrastructure and the transportation study <br />that will document that we can develop at those levels. <br />Les Brockman asked Attorney Brandenburg what would occur if - <br />one of the municipalities decided not to adopt this plan, and <br />Attorney Brandenburg explained that they would then be designated <br />by the DCA as an area of critical concern and be forced to adopt <br />the same regulations. The DCA then would have greater control <br />over the area because any development that occurs in that area <br />must not only get the local government's approval, but the DCA's <br />as well, with the Governor and Cabinet sitting as the adminis- <br />tration commission in some instances. <br />Steve Henderson, local attorney, believed that the proposed <br />ordinance contained a pretty clear statement about what was <br />exempted in terms of approved site plans, but asked for a clari- <br />fication as to how this would affect a developer who has an <br />approved site plan and wished to either modify it or seek <br />extensions on it. <br />Attorney Brandenburg felt that if the modifications did not <br />increase the densities, the ordinance would not apply to any <br />modifications or extensions. <br />Attorney Bill Caldwell asked whether the State would stop <br />the rule-making process if this resolution is adopted, and <br />Attorney Brandenburg advised that if we adopt this resolution and <br />67 <br />Nov <br />I 8 IgA`?
