LI <br />Intergovernmental Relations Director Tommy Thomas advised <br />that the Department of Natural Resources has given a verbal <br />extension on the final payment for this project. He reported <br />that when the ocean broke through the dune during the Thanksgiving <br />storm, it actually took the pressure off the crossover structure. <br />Public Works Director Jim Davis reported that as of the <br />Monday after the storm, there was no major structural damage done <br />to the crossover, but he recommended that final payment on the <br />crossover be subject to the Engineering Department doing a <br />structural inspection sometime this week. <br />Commissioner Wodtke was concerned that the contractors for <br />the crossover and the revegetation would not be paid for their - <br />work which he understood was completed before the storm, and <br />Chairman Scurlock believed that if the County did not pay these <br />contractors for work that was completed before Mother Nature took <br />it away, the County would have great difficulty in the future of <br />finding contractors to bid on these types of projects. <br />Attorney Brandenburg recalled that the short contract form <br />used for these contracts did not include the standard clauses <br />regarding acts of God and the responsibility of the contractor to <br />insure the property prior to final acceptance by the County, and, <br />therefore, it is up to the Commission to decide how to handle <br />payment. <br />Director Davis advised that the two contractors did an <br />excellent job, and it was very unfortunate that the storm did so <br />much damage. <br />Mr. Haeger addressed the Board and stated he would like to <br />be paid for the major part of the work and would be glad to <br />restore the vegetation at an additional cost. He reported that <br />less than 30% of the vegetation is left and that includes what <br />they recovered after the storm.
