REPORT RE POSSIBLE DESIGNATION OF BARRIER ISLAND AS AREA OF <br />CRITICAL CONCERN <br />Attorney Brandenburg reported that he received a phone call <br />from Tallahassee yesterday, and Mr. Nabors and Betty Steffens <br />have been working on our situation with the Department of <br />Community Affairs and the chief of Governor Graham's staff and <br />his counsel, and they feel they are making some headway regarding <br />our county's relationship to the area of critical concern <br />designation. One of the things they brought to the Department's <br />attention is a sort of misconception the Department had. The DCA <br />had been telling all three counties they would go through the <br />designation process but as -soon as we complied, they would pull <br />back the designation; it appears they did not realize that the <br />statute itself indicates that as soon as you are designated, you <br />must stay designated for a period of one year. The Attorney <br />believed this puts the head of DCA in a difficult position <br />because it is contrary to the position he has been taking with <br />the Committee itself. We are trying to get across the point that <br />our county would like to see them either not make a recommenda- <br />tion to go through the designation process at all and give us <br />another year to come into compliance and complete studies or <br />specifically delete from their list of what this county has to do <br />that the barrier island be reduced to one unit per acre. The <br />Attorney felt either action would give us assurance we would not <br />be designated and we could move ahead without the moratorium or <br />resolution adopted last week. <br />Attorney Brandenburg further informed the Board that <br />December 18th is when the Governor and Cabinet will consider all <br />recommendations, and he would like permission to go to <br />Tallahassee to attend that meeting and possibly the other <br />Commissioners could go also. <br />Chairman Scurlock felt the more support we have up there, <br />the better it will demonstrate our interest. <br />37 <br />D E C 5 1984 <br />BOOK ..5 PAGE 1 15 <br />
