• To state the consequences for failure to adhere to the regulations, <br /> as in all code enforcements; <br /> • To identify the owner of the property as the responsible party for <br /> notifying the renter of these regulations; and <br /> • To establish the owner of the property as the responsible party for all <br /> compliance and non-compliance matters. <br /> Attorney DeBraal inquired if Mr. Conway had evidence to support his claim <br /> that the more vacation rentals occurred, the more sea turtle violations occurred. <br /> Mr. Conway pointed out permanent residents advised each other if a sea <br /> turtle nest was in the area so they could pull their blinds or adjust their lighting; <br /> however new batches of transient rental residents, unaware of lighting <br /> restrictions, projected lights onto the nests and disoriented sea turtle hatchlings. <br /> Mr. DeBlois opined there was no evidence to support the assertion that <br /> vacation rentals incurred more violations of sea turtle lighting than any other <br /> individual or group. <br /> Mr. Conway maintained there would be no way of knowing because 90% <br /> of all boarding houses were unlicensed. He wanted the ordinance to differentiate <br /> penalties for people using their own property for living as opposed to <br /> homeowners using their property as transient boarding houses or for events such <br /> as weddings or commercial uses as advertisement production. <br /> Mr. Conway also recommended including the dune and the berm in the <br /> definition of the protected area of the beach, and was in favor of the County <br /> hiring an outside attorney when issues involving transient rentals were brought <br /> before the Code Enforcement Board. <br /> Chairman Polackwich closed the public hearing at 7:56 p.m. <br /> ON MOTION BY Mr. Brognano, SECONDED BY Mr. <br /> Stewart, the members voted unanimously (4-0) to <br /> recommend the Board of County Commissioners <br /> approve the draft ordinance with the minor t <br /> language modification made by Chairman <br /> Polackwich. <br /> Mr. Boling suggested adding verbiage to annual notices sent out by staff <br /> prior to sea turtle nesting season stating beachfront property owners were <br /> responsible for the actions of anyone on their property that violate the lighting <br /> restrictions. <br /> ATTACHMENT <br /> PZC/Approved 4 June 11, 2015 <br /> F:\BCC%A11 Committees\P&Z\2015—AGENDAS & MINUTES\P&Z-06-11-15.doc 240 <br />
