i <br /> ON MOTION BY Mr. Brognano, SECONDED BY Ms. <br /> Caldarone, the members voted unanimously (4-0) to <br /> recommend the Board of County Commissioners <br /> that staff include verbiage in the annual letter to <br /> beachfront property owners that they inform any <br /> renter or visitor to their property about the turtle <br /> lighting ordinance and the owners were responsible <br /> for the actions of anyone on their property. <br /> Chairman Polackwich asked the members if anyone wanted to consider <br /> greater penalties for vacation rental violators. Nobody expressed interest in <br /> doing so and the issue was dropped. <br /> Mr. DeBlois noted there were provisions in the IRC Coastal Management <br /> element of the code relating to protection of the dune for uses that physically <br /> affected the dune, including protection against impacts to sea turtle nests. He <br /> added he knew of no other Florida county that went above and beyond the State <br /> model ordinance and felt inclusion of a dune illumination restriction area would <br /> set a precedent. <br /> It was the consensus of the PZC not to recommend an extension of the <br /> ordinance to include the dune. <br /> Chairman Polackwich inquired if the members were in favor of the County <br /> employing an outside attorney to present violations of turtle ordinance <br /> enforcement actions by vacation renters to the Code Enforcement Board. <br /> None of the members expressed an interest in making the above <br /> recommendation. <br /> Mr. Boling announced staff anticipated presenting this issue to the BCC on <br /> August 18, 2015, or at the Board's first meeting in September, 2015. <br /> For clarification, Chairman Polackwich asked for a separate motion not to <br /> extend the ordinance to include the dune area. <br /> ON MOTION BY Mr. Brognano, SECONDED BY Mr. <br /> Stewart, the members voted unanimously (4-0) to <br /> recommend the Board of County Commissioners <br /> not extend the turtle ordinance to include the dune <br /> area. <br /> ATTACHMEIfT 3 <br /> PZC/Approved 5 June 11, 2015 <br /> F:IBCCWII CommitteesT&Z12015 —AGENDAS & MINUTESIP&Z-06-11-15.doc 241 <br />
