F- I <br />DEC 12 1984 aooK 5 9 F ! � <br />Commissioner Wodtke noted that the Hearing Board shall be <br />made up of "residents of the County," and he suggested it should <br />be "voting" residents. He further noted that the doctor member <br />is to be recommended by the County Medical Society and the <br />Engineer by the local chapter of the Florida Engineering Society; <br />therefore, he felt the lawyer should be recommended by the local <br />Bar Association. <br />Attorney Brandenburg agreed these items could be corrected. <br />Commissioner Bird inquired about staggered terms, and <br />Attorney Brandenburg stated that could be dealt with also and <br />could be established by Resolution. <br />Commissioner Wodtke asked if this Board could invoke a fine <br />and was informed that it could. Attorney Brandenburg explained <br />that actually the County Commission is the Environmental Control <br />Board and adopts the regulations that the Hearing Board enforces. <br />Commissioner Wodtke asked if there is a possible conflict <br />where the Commission make certain decisions, but then as the <br />Environmental Control Board will be wearing different hats. <br />Attorney Brandenburg stated that this doesn't seem to have <br />caused problems in other counties which have adopted this type of <br />procedure. He pointed out that it is a very similar concept to <br />the Code Enforcement Board. <br />Mr. Galanis noted that the proposed Bill was copied from one <br />adopted for a larger county, and possibly holding a meeting less <br />frequently than every 45 days would be sufficient. He noted that <br />while the Hearing Board does make decisions, they can be <br />appealed; however, nine out of ten matters are generally solved <br />at the Hearing Board level. <br />Commissioner Bowman felt there are some points that need to <br />be fine tuned in regard to length of terms, etc., and Attorney <br />Brandenburg stated that could be handled either separately or by <br />resolution. <br />Discussion continued regarding how the procedure would work, <br />and whether this Board will make decisions on state requirements. <br />
