DEC 19 1984 <br />BOOK 59 F,9GF 2 5 7 <br />maintain the plant during the seven years that he has lived <br />there, and urged the Board to be fair in this matter. <br />Commissioner Bird asked what rate he would consider to be <br />fair, and Mr. Andress suggested that some things could be marked <br />off the list to save money, and pointed out that the electrical <br />bill is too high because the pump runs constantly. He also <br />pointed out that in other subdivisions, all property owners must <br />pay their share. He believed that when Angler's Cove is fully <br />developed and everyone connects, the plant's capacity would be <br />overtaxed. <br />Director Pinto agreed with everything Mr. Andress said, but <br />pointed out that if the County enforces all these improvements, <br />the 12 customers would end up paying for them. He still <br />recommended that they go with a temporary franchise and give the <br />owners the increase until such time when an alternative can be <br />found and the plant can be dissolved. He reported that the <br />Health Dept. has taken a position that all residents must go on <br />septic tanks if the plant is to be eliminated; one home there <br />already is on a septic tank. <br />Another owner of the wastewater facility, Clark A. DePue, <br />III, stated that even though there has been a minimum charge to <br />date, they have had trouble collecting the water fees from a few <br />of the residents. He pointed out that Page 4, Section 12, of <br />the franchise, it states that the owners are entitled to a "fair <br />rate of return". Mr. DePue corroborated that they have a quit <br />claim deed with them today and would be glad to turn the plant <br />over to anyone who would be willing to operate it. <br />Commissioner Wodtke hoped that during the 30-60 days the <br />Board will take to consider this rate request, perhaps they can <br />hook up to the Moorings system or some decision will be made by <br />the City. Meanwhile, this is a franchise and the plant has to <br />operate and provide service for all the people. He felt the <br />modified franchise would give the County better control over the <br />35 <br />
