Pinto , <br />Utility Services Director MODIFICATION AND <br />SUBJECT: TRANSFER OF FRANCHISE - <br />PELICAN POINTE UTILITIES <br />FROM: Joyce S. Hamilto REFERENCES' A) Request for transfer <br />Franchise Administfor B) Revised resolution <br />Utility Services <br />DESCRIPTION AND CONDITIONS: <br />Pelican Pointe Utilities, Inc., was granted a water and wastewater <br />franchise on September 7, 1983. Mr. Vernon Foster, president, <br />has formed a new corporation -P & P Utilities, Inc. -and has requested <br />the County to transfer its franchise to P & P Utilities, Inc., <br />(Exhibit "A"). <br />ALTERNATIVES AND ANALYSES: 4 <br />P & P Utilities, Inc., has met all requirements of the County to <br />transfer this.fr.anchise. <br />This department has taken this opportunity to make one update <br />in the resolution which is to co -name Indian River County as an <br />additional insured on the liability policies. P & P Utilities <br />does not have any objectives to this modification (Exhibit "B"). <br />RECOMMENDATION: <br />Staff recommends the Board authorize its chairman to execute <br />the attached resolution granting this transfer -and modification <br />of franchise. <br />Chairman Scurlock asked if the rate structure is sufficient <br />to operate this plant, and Utility Services Director Terry Pinto <br />felt that there is an adequate rate structure, but noted that it <br />is difficult to estimate because this plant is not in operation <br />as yet. <br />Chairman Scurlock felt we need a vehicle to evaluate these <br />rates to see if they are sufficient. <br />Commissioner Wodtke understood, basically, the only thing <br />we are being asked is to allow the formation of a new <br />corporation, and Director Pinto explained that the owner is just <br />37 <br />
