He felt the <br />transportation element is really the key and hoped that the <br />developers would not be encouraged to run in and vest a site <br />plan that they have no intention of developing in the near <br />future. However, if they do attempt to vest a site plan, he <br />suggested that we develop a tool where we can keep a cautious <br />eye to see that they are moving forward into construction and <br />completion. <br />Commissioner Wodtke asked if a developer comes in tomorrow <br />and requests some of the 600 remaining units, can we approve it <br />with the understanding that they are going to participate in any <br />impact fee that would be imposed as a result of the <br />transportation analysis so that, in essence, they would not be <br />using up something that was free. <br />Attorney Brandenburg stated that whenever a barrier island <br />development is approved, the Board has to be mindful of the <br />traffic situation that currently exists and the limited amount <br />of capacity that currently exists on the bridges. If a <br />development comes in between now and the time the transportation <br />study is completed, it should be reviewed under those terms. If <br />the Board feels that they are taking up too large a chunk of the <br />remaining capacity, they also can require the developer to <br />implement certain mitigating factors such as construction of <br />turn lanes and other improvements. In addition, the impact fee <br />that the County will adopt ultimately will probably key in the <br />building permit or certificate of occupancy stage. He felt it <br />is unlikely that many units would be built even if a lot of <br />projects are approved in this interim period, and emphasized <br />that the impact fee, in any event, would be imposed on all the - <br />unbuilt units. <br />Commissioner Bird asked how we could collect revenue from <br />projects that are approved before an impact fee is in existence, <br />and Attorney Brandenburg advised that the revenue would come <br />from a building permit or a certificate of occupancy and that <br />DEC 19 <br />I BOOK 59 PGE,��6 <br />
