Keats g, P <br />Planning & Development Director <br />FROM: Richard Shearer, AICP REFERENCES: <br />Chief, Long -Range Planning <br />POTEAT APPEAL OF THE <br />PLANNING & ZONING COM- <br />MISSION'S_DENIAL OF HIS <br />REQUEST TO REZONE 20 <br />ACRES FROM A, AGRICUL- <br />TURAL DIST., TO C-1, <br />COMMERCIAL DISTRICT <br />ZC-101 <br />CHIEF <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of January 2, 1985. <br />DESCRIPTION & CONDITIONS <br />Michael O'Haire, an agent for Willie Florence Poteat, the <br />owner, is appealing a November 8, 1984, decision by the Plan- <br />ning and Zoning Commission to deny a request to rezone 20 acres <br />located 600 feet west of Kings Highway on the south side of <br />State Road 60 from A, Agricultural District, to C-1, Commercial <br />District. <br />The Planning and Zoning Commission voted 4 -to -0 to deny the <br />subject request, and they gave several reasons for the denial. <br />Those reasons are as follows: <br />1) They did not feel that the subject property could be <br />included in the Kings Highway/S.R.60 commercial node. <br />2) Commercial zoning should not extend indefinitely along <br />State Road 60. <br />3) The line between commercial and noncommercial zoning <br />had to be drawn somewhere. <br />The applicant proposes to develop this property for commercial <br />uses. <br />ALTERNATIVES & ANALYSIS <br />In this section, an analysis of the reasonableness of the <br />application will be presented. The analysis will include a <br />description of the current and future land uses of the site and <br />surrounding areas, potential impacts on the transportation and <br />utility systems, and any significant adverse impacts on <br />environmental quality. <br />Existing Land Use Pattern <br />The subject property contains a single-family dwelling, a fruit <br />stand, and an old citrus grove. North of the subject property, <br />across State Road 60, is undeveloped land zoned C-1. East of <br />the subject property is an undeveloped parcel of land zoned <br />C-1, Commercial District. South of the subject property is <br />undeveloped land zoned Agricultural. West of this property is <br />Mueller Center of Indian River Community College. West of the <br />subject property is a citrus grove zoned Agricultural. <br />34 <br />
