Goetzfried REFERENCES: Riverbend <br />Chief, Current Development Section DIS:MARYJ <br />It is recommended that the data herein presented be given <br />formal consideration by the Board of County Commissioners at <br />their regular meeting of January 2, 1985. <br />DESCRIPTION AND CONDITIONS: <br />Pursuant to Section 23 (h)(1) Appendix A of the County Code, <br />the Board of County Commissioners is afforded the authority to <br />evaluate the validity of an approved site plan, when there is a <br />question with regard to commencement or abandonment of con- <br />struction. <br />The Code specifies that construction will have commenced when <br />the developer has built a portion of a structure shown on the <br />approved site plan (e.g. the pouring of footers), or has made <br />substantial improvements to the site, other than land clearing, <br />filling or grading, evidencing a good faith effort to diligent- <br />ly pursue construction to completion. <br />In cases where construction has commenced, and subsequently <br />been abandoned or suspended, the site plan approval shall <br />terminate and become null and void after notice and hearing by <br />the Board of County Commissioners. Construction shall be <br />considered abandoned or suspended if at the hearing it is shown <br />that an active building permit has not been maintained for the <br />construction of a structure in accordance with the approved <br />plan, or it is shown to the satisfaction of the Board of County <br />Commissioners that construction at a level indicating a good <br />faith effort to proceed with the completion of the project has <br />not occurred for a continuous period of six (6) months, unless <br />the inactivity is attributable to the deliberate and scheduled <br />phasing of a multiphase project which has been approved as such <br />by the County. <br />Florida Land Company has submitted several site plan applica- <br />tions involving the proposed Riverbend multi -family residential <br />project. <br />County records reflect the following CHRONOLOGY OF EVENTS with <br />regard to the site plan approval process of Riverbend: <br />September 17, 1980 Site plan application submitted <br />by Florida Land Company to <br />construct 504 multi -family <br />units. <br />Application was subsequently <br />terminated, at applicant's <br />request, to allow for the <br />County's consideration of an <br />inland marina. <br />45 <br />2 1995 <br />JAS R'�01K 519, olrr.13 <br />
