By adopting new land <br />development related ordinances, the County Commission has <br />determined that the adherence to the requirements set forth in <br />said ordinances is in the public's best interest. <br />Since approval of Riverbend, the following applicable ordi- <br />nances have been adopted. <br />1) Stormwater Management & Flood Protection <br />2) Off-street Parking Pavement Types <br />3) Off-street Parking & Loading Regulations <br />4) Tree Protection <br />The Hutchinson Island Resource Planning and Management Plan did <br />consider Riverbend and the anticipated 1,734 average daily <br />trips when assessing bridge capacity; however, the recently <br />updated North Beach Unit Allocation report, prepared by the <br />Planning Department, did not include the average daily trips. <br />This was due to the fact that the applicant did not hold an <br />active building permit when the report was prepared. <br />CONCLUSION: <br />Considering the effects of the aforementioned, recently <br />approved ordinances on large scale residential/commercial <br />development proposals, and the effect of this project on the <br />barrier island's principal transportation system and the <br />development restrictions proposed by the Hutchinson Island <br />Resource Planning and Management Plan, it would be in the <br />public's best interest to terminate approval of the Riverbend <br />site plan application. <br />Termination of the existing approval would still permit the <br />applicant to submit a new site plan application in conformance <br />with the County's current Code of Laws and Ordinances. <br />RECOMMENDATION: <br />Staff recommends the approved site plan to construct Riverbend <br />at 9025 State Road A -1-A be terminated. <br />Planner Goetzfried displayed slides of the construction site <br />of the subject project taken last Friday, which demonstrate that <br />the only construction has been the removal of fill from the lake <br />and noted that it is obvious this site was approved prior to a <br />number of ordinances now in effect. <br />Commissioner Scurlock stated that his real problem is that <br />we need to find a vehicle to have a much tighter control on this <br />whole process; there are those who want to carry out their <br />project in good faith but have financial problems, and then there <br />are those who obviously have no intention of proceeding, but have <br />options on the property and try to get vested so they can sit <br />with the property and speculate.
