Commissioner Scurlock inquired if they plan to build under <br />that specific site plan and just what specific construction <br />activities have taken place. <br />Mr. Chancellor stated that the North Beach Water Company is <br />the only specific construction, and noted that they would like to <br />work with staff and possibly revise the site plan. <br />Commissioner Bird asked if any revisions would be in <br />concurrence with all new ordinances, and Mr. Chancellor assured <br />him that they would. <br />Attorney Michael O'Haire emphasized that the main issue the <br />Board is being asked to determine relates to a "good faith" <br />effort, and he felt that not only has the Commission not seen any <br />evidence of "good faith," they have seen positive evidence of bad <br />faith as demonstrated by the rape of island, which is clearly <br />shown in the slides presented by staff. He further noted that <br />clients of his have been shown this property as being available <br />for purchase. He believed the new company has a mandate to sell <br />it. <br />Chairman Lyons made the point that as far as the water plant <br />being used as evidence of their good faith is concerned, they had <br />an agreement to do that in conjunction with other parties, and <br />were, therefore, more or less forced into pursuing it. <br />Mr. Chancellor stated that they wanted to construct the <br />plant because they could not build without a potable water <br />supply. <br />Planner Goetzfried informed the Board that the site plan <br />originally approved for the permanent reverse osmosis plant for <br />North Beach was preceded by a site plan request for a temporary <br />R. O. plant that has been on line at Sea Oaks since they were <br />originally approved. <br />Attorney Brandenburg stressed that the site plan for the <br />water plant was totally separate from the subject site plan and <br />that does not meet the specific requirement for substantial <br />improvement to the site. <br />51 <br />ENEWATwou <br />MOO F4.,�341 <br />
