-I <br />JAN 21985 <br />BOOK 59 PCE 3 42 <br />Chairman Lyons agreed that what he was trying to establish <br />earlier was that the water plant was an independent operation. <br />As to "good faith," Mr. Chancellor noted that the water <br />plant is half on their property and half on Sea Oaks. He felt <br />the expenditure of approximately one million dollars by April of <br />this year does constitute a good faith effort on their part. <br />Commissioner Bird asked how it would really hurt them if the <br />Commission ruled this site plan invalid since it apparently is <br />not their present intention to build according to that plan., <br />Mr. Chancellor pointed out that they then probably would get <br />back to a density question. This property originally was <br />purchased at a density of 12-15 per acre and that was the basis <br />of the purchase; now it is down to 6 per acre and there comes a <br />point when the project is not feasible. <br />Commissioner Scurlock felt the only way the density question <br />would come in would be if the Hutchinson Island Resource Manage- <br />ment Plan were enforced. <br />Commissioner Wodtke asked if the lakes were built according <br />to the site plan, and Mr. Chancellor stated that those are two <br />large storm water retention ponds, and land clearing and grubbing <br />was done also. <br />Edward Green, resident of Summerplace, asked if this is the <br />same company which a couple of years ago tried to build a bridge <br />on Jungle Trail, and if so, he would wonder about their <br />credibility. <br />Commissioner Scurlock noted that it is a different company, <br />but the same group. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Bowman, to approve staff's recommenda- <br />tion to consider the site plan of Riverbend terminated <br />on the basis that they have not complied with the <br />ordinance's criteria relating to a "good faith" effort <br />since construction was never started. <br />52 <br />� � r <br />
