JAN 1 <br />1985 <br />BOOK <br />59- Fir;470 <br />Planning <br />Director Keating reported that we do have <br />a table <br />showing the permitted uses in each District and staff will <br />develop a comparison table. <br />Chairman Lyons asked if the Attorney is suggesting we hold <br />back on considering this today, and Attorney Brandenburg <br />clarified that the Board could adopt these as new zoning <br />districts today, but could not reclassify any land to those new <br />districts until the two night public hearings were held. Until <br />this is accomplished, we actually would have two sets of <br />residential zoning districts, and the old would apply until the <br />land is reclassified. <br />Attorney Brandenburg then read to the Board a paragraph <br />which he would like to add to the end of this ordinance to show <br />how this works. He suggested that Section 15. Repeal of <br />Conflicting Provisions be eliminated and in its place the <br />following stated: "Until further action has been taken by the <br />Board of County Commissioners by the adoption of appropriate <br />ordinance, the zoning districts created by this ordinance shall <br />be considered additional districts. The administrative sections <br />of this ordinance requiring general and specific use criteria <br />shall only apply to the districts created by this ordinance and <br />subsequent ordinances of the Board. All further rezonings shall <br />where applicable utilize the newly created districts. <br />Commissioner Wodtke questioned the advantage of proceeding <br />this way, and Attorney Brandenburg pointed out that as soon as <br />the Board adopts these new districts, anyone applying for <br />rezoning will have to use the new districts. <br />Commissioner Wodtke expressed concern about former uses that <br />are no longer allowed in the new districts, the possibility of <br />people doing things in the period before the old districts can be <br />repealed that are no longer permitted in the new districts, etc., <br />Attorney Brandenburg confirmed that if someone was allowed a <br />use in R-1 that would no longer be allowed in RS -3, he would be <br />grandfathered in and become a non -conforming use in the new <br />16 <br />M <br />
