Commissioner Scurlock felt that the utilities being in place <br />has made the parcel more marketable, and pointed out that on the <br />SR -60 water and sewer projects, some of the developers had <br />voluntarily paid the assessment even before receiving site plan <br />approval. <br />Attorney Brandenburg suggested that if Mr. Nutt was <br />agreeable to postponing this matter, there might be just a few <br />changes necessary to comply with the ordinances which were passed <br />after the approval of the site plan. He believed that if Mr. <br />Nutt agreed to do that, he would be satisfying the requirements <br />behind today's hearing. <br />Mr. Nutt felt that the question here is "good faith effort", <br />and believed he has made a conscientious and good faith effort <br />and spent a lot of money in doing so. He believed that it should <br />be sufficient for him to express a spirit of cooperation to work <br />with the County and did not feel that he could give a carte <br />blanche agreement that his site plan would be changed in order to <br />comply with the requirements of all the new ordinances. <br />Attorney Brandenburg explained that Mr. Nutt would be just <br />postponing this meeting until such time as he could review the <br />ordinances to see if they would affect this site plan, but Mr. <br />Nutt emphasized that he is ready to proceed with construction. <br />Director Keating did not feel that they would be severely <br />impacted by any of the new ordinances other than the stormwater <br />management ordinance. He pointed out that there has been a <br />change in the County's philosophy on development since this site <br />plan originally was approved, and the specific reason for <br />reviewing this site plan is due to opinions expressed in public <br />hearings on other projects in this area that Sea Oaks might never <br />develop and that the Commission should review the project. <br />Commissioner Bird understood that Director Keating was not <br />saying that this Commission is going to review all previously <br />approved site plans that are in the process of construction to <br />see if they are in compliance with the new ordinances that have <br />42 <br />BOOK Pr�GF 664 <br />JAN 2 3 1985 <br />
