they are here today prepared to show that a good faith effort has <br />been made. <br />Attorney Brandenburg felt that Attorney Stewart is concerned <br />that staff might find new evidence; he emphasized that staff has <br />said that they do not have anything else to say, and there is no <br />desire to hurt the applicant. <br />Commissioner Scurlock felt that Mr. Nutt would have the <br />opportunity to show intent by going out there and building the <br />project. <br />Chairman Lyons expressed his reluctance to cancel the site <br />plan even though he felt good diligence has not been shown. He <br />hoped there could be some way to get this settled without this <br />impass, and felt that perhaps a postponement would give assurance <br />to Mr. Nutt that the new ordinances do not significantly impact <br />his site plan. <br />Attorney Brandenburg stressed that the Board eventually has <br />to determine whether a good faith effort has been made and that <br />progress has not come to a halt for a period of six months. <br />Attorney Stewart continued to argue that the burden is on <br />the County to show that sufficient activity has not occurred, and <br />did not feel that sufficient proof had been shown by staff. He <br />felt that if this public hearing is to be postponed, the reasons <br />for the postponment should be identified, a timetable established <br />as to when it would come back before the Board, and that it <br />should be determined what will transpire at that meeting. <br />Chairman Lyons believed that the County does have sufficient <br />evidence demonstrating that the applicant has not proceeded as <br />required. <br />Commissioner Scurlock was concerned abut the impact this <br />will have on the Hutchinson Island Resource Management Plan. <br />Attorney Stewart stated that his client is willing to give a <br />partial schedule of completion today and the balance in a letter <br />afterwards. <br />44 <br />`JAN 23 1985 <br />BOOK 59 PACE 686 <br />
