staff members and agrees that it is the correct amount. User also <br />acknowledges that this amount does not include any of the other <br />charges set forth in the Indian River County Utility Ordinance (No. <br />84-18), as now in existence or as amended in the future. User <br />understands that when the Department of Environmental Regulation <br />certifies the County system as capable of providing service to <br />User's site (if it is not already so certified), then User must <br />begin paying Indian River County, a base facility's charge, as set <br />forth in Ordinance No. 84-18, for each ERU reserved. It is User's <br />responsibility <br />to <br />arrange <br />for, <br />pay for, <br />and <br />coordinate the <br />interconnection <br />of <br />User's on <br />site <br />distribution <br />or <br />collection system <br />to the point of connection with County's system. The County does <br />not guarantee the timing of the availability of service to the site <br />but agrees to use its best efforts to have the water available to <br />meet User's time schedule. <br />3. County agrees that User may pay the impact fee set <br />forth in Paragraph 2 over a three-year period in 36 -equal monthly <br />installments, unless the County adopts an ordinance extending the <br />time for payment, in which case User may pay over the extended <br />period, bearing interest at one percent above prime adjusted yearly <br />on the anniversary date of this Contract, provided User executes a <br />Promissory <br />Note <br />or Mortgage (or <br />other <br />instrument) securing <br />the <br />payments. <br />Such <br />documents must <br />be in <br />a form Satisfactory to <br />the <br />County Attorney. <br />WHEREFORE, the parties hereto have set their hands and <br />seals on the date set forth next to their signatures. <br />Dated 1/23/85 BOAR COUNTY COMMISSIONERS <br />INDIi IVER COUNTY <br />Attest: _ <br />Freda Wright, Clerk P r k ., Lyo irman <br />Dated <br />Adam McGavin <br />STATE OF FLORIDA <br />COUNTY OF INDIAN RIVER <br />I HEREBY CERTIFY that on this day before me, an officer duly <br />authorized to take acknowledgments, personally appeared Patrick <br />B.
