JAN 2 3 1985 <br />BOOK 59 F�rE 677 <br />AGREEMENT FOR THE PAYMENT OF IMPACT FEES <br />WHEREAS, the Board of County Commissioners of Indian <br />River County has undertaken a program of developing a County water <br />and sewer system to meet the demands of a growing community, and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County has enacted Indian River County Ordinance No. 84-18 <br />requiring the payment of- an impact fee for each equivalent <br />residential unit connecting to the County system to help defray a <br />portion of the capital costs of the system associated with the <br />increased demand, and <br />WHEREAS, the Utility Ordinance also provides that the <br />Commission may establish alternate methods of payment for units <br />presently in existence, which have received Certificates of <br />Occupancy from the County and now desire to connect to the County <br />system. <br />NOW, THEREFORE, this Agreement is made this 23rd <br />day of January , 1985, by and between Indian River County, a <br />political subdivision of the State of Florida, referred to herein <br />as "County" and ADAM McGAVIN, referred to herein as "User." <br />1. The User desires to have the County's water <br />system available to his site generally described as: <br />HOLIDAY VILLAGE MOBILE HOME PARK, <br />a more specific description of which is attached hereto Exhibit <br />"A." The County believes that it is in the best interest of User <br />and the other customers of County's system to service the User's <br />site, and that it would constitute an undue hardship to require <br />User to prepay the entire impact fee upon execution of this <br />Agreement. <br />2. <br />The County <br />has determined that <br />User's site will <br />require 128 <br />equivalent residential <br />units (ERU's), <br />and that the <br />total impact <br />fee for the <br />water <br />service shall <br />be $132,519.68, <br />pursuant to <br />Indian River <br />County <br />Ordinance No. <br />84-18. User <br />acknowledges <br />reviewing the <br />amount <br />of the impact <br />fee with County <br />-1- <br />
