I <br />FEB 6 1995 BOOK 5 N cE 780 <br />DESCRIPTION & CONDITIONS: <br />On January 14, 1983, the County Planning & Development Division <br />approved a house relocation application submitted by Cyril <br />Schock to relocate and bring into compliance with the Standard <br />Building Code and all applicable zoning regulations a 1400 <br />square foot residential building to be moved to 5570 59th <br />Terrace. At that time, the applicant tendered to Indian River. <br />County a cash bond of $3,500. A one-year time limit for <br />completion of the project was a condition of the approval, with <br />forfeiture of the bond possible if the project was not <br />completed in the required time frame. <br />Due to financial and personal setbacks within that year, Mr. & <br />Mrs. Schock were unable to complete -the house relocation prior <br />to the expiration of the one-year time limit. The applicants <br />then requested that the Board of County Commissioners grant <br />a one-year.extension to the required one-year time limit as <br />referenced in Section 25(n)(2) of the County's zoning code. <br />At that time the Board was assured by Mr. Schock that the house <br />relocation would be completed within one year of the original <br />completion date. On May 16, 1984, the Board of County <br />Commissioners approved the applicants' request for a one year <br />extension to the house relocation permit, making the new <br />expiration date January 14, 1985. <br />ANALYSIS <br />On January 11, 1985, prior to the expiration of the one-year <br />extension, an inspection of the house relocation project by <br />Betty Davis, County Code Enforcement Officer, and Jim Fish, <br />Assistant County Building Director, revealed that the project <br />was approximately 50% complete. The inspection revealed that <br />the following items had been completed. <br />Outside: Septic tank installed. <br />Meter box and service mast installed. <br />New windows whole house. <br />Inside: New electric panel. <br />Electric wiring and receptecles etc, being installed. <br />Insulation - all walls both interior and exterior <br />being insulated. <br />First & 2nd floor ceiling being insulated. - <br />Approximately 85% complete. <br />Plywood on floors. <br />During the inspection, the staff also noted that there was an <br />accumulation of construction material and debris located on the <br />site. <br />It is the staff's postion that the applicants have not acted in <br />good faith to comply with the requirements of the house <br />relocation permit. In the two year period since the permit was <br />issued, only half of the required reconstruction has occurred. <br />The applicants not only failed to meet the original permit <br />expiration date; they also failed to comply with the extended <br />deadline. <br />31 <br />r <br />
