In establishing time frames and requiring performance bonds for <br />completion of such projects, the County has recognized that <br />structures must meet applicable building codes and that a means <br />of ensuring that compliance with those codes is achieved in a <br />reasonable time period must be established. Since the bond <br />serves that purpose, the bond must be called when specified <br />conditions are not met. In this case, the staff feels that the <br />County should exercise its option and require forfeiture of the <br />bond. These funds should then be used by the County to either <br />bring the subject structure into compliance with all applicable <br />codes or demolish the structure. <br />RECOMMENDATION: <br />Staff recommends to the Board of County Commissioners that no <br />further extensions of time be granted to the applicants, that <br />the $3,500 bond be forfeited, and that the County take the <br />necessary actions to either demolish the structure or have it <br />brought up to code. <br />Planning & Development Director Robert Keating explained <br />that the bond has expired and at this date the building is only <br />50% completed. In the past two year period, staff feels it is <br />evident that the applicant has not been making a good faith <br />effort in compliance with the agreement he had with the County <br />and that the County, therefore, has to be willing to take <br />enforcement action and call the bond. <br />Commissioner Scurlock asked if that means the owner could <br />either improve the building or take it down; Administrator Wright <br />felt that it could not be improved, but did suggest that we give <br />the owner another 120 days and then tear it down. <br />Chairman Lyons reported that he has been out there and the <br />house is just a mess and is next door to a very nice looking <br />home. <br />Commissioner Bird asked what Schock's latest promise is, and <br />Code Enforcement Officer Bette,Davis stated that the applicant <br />has obtained financing through a personal friend and hopes to <br />have it completed by the end of January. <br />Attorney Brandenburg stated there is a cash bond and asked <br />how much money would be required to bring the building up to <br />Code. <br />Director Keating stated that the original estimate was <br />$3500, Which was the basis of the bond, and Attorney Brandenburg <br />32 <br />.� <br />BOOK Pr�E 8,-L <br />
