M <br />granted a rezoning of their 25 acre tract west of AIA to 6 units <br />per acre. Attorney Caldwell emphasized the County's site plan <br />requirements are extensive, and the developer has spent over <br />$250,000 in the last year or so, and has worked very intensely <br />with staff for the last 9 months. The site plan was filed by the <br />owner/developer one week prior to the first moratorium resolution <br />and he believed there was another site plan filed by someone <br />holding an option on the Nutt property. He urged the Board to <br />consider the vesting argument in re to the Orchid Island Club. <br />He believed that it may well be that the expansion of the North <br />Beach Water Company is viable because of the purchase of water <br />taps. <br />Commissioner Scurlock asked Attorney Caldwell if a decision <br />were rendered in Orchid Island Club's favor, were they talking <br />about beginning construction and carrying the project through to <br />completion? <br />Attorney Caldwell felt their intent is to have a model ready <br />for marketing this coming season. <br />Commissioner Scurlock noted that they could wait till June <br />or July to start construction and still have time to have a model <br />in place for next season which would give them an opportunity to <br />see the results of the transportation analysis. <br />Attorney Caldwell stressed that the owners of north beach <br />properties are trying to convince the Board that they have vested <br />rights and that if the State came along and tried to take them <br />away, they would be paying for.the dimunition in the value of the <br />real estate. He further stressed that if staff had processed the <br />site plan application and if the moratorium resolution had not <br />been adopted, the site plan would have been through by now. <br />Attorney Brandenburg understood that the site plan takes the <br />density from the west and brings it up to 12 units per acre on <br />the ocean, but Attorney Caldwell pointed out that was done with <br />the County's participation and not at the last hour before the <br />moratorium. <br />49 <br />FEB 6 1985 BOOK �9 P; OF 7119 <br />
