FEB 6 1995 BOOK 59 F,acF 800 <br />Director Keating explained that the development is on both <br />sides of AIA and they plan to cloister their units on the east <br />side of AIA and put in some recreational facilities on the west <br />side of AIA. Staff considers it a normal site plan where units <br />are cloistered on one part of an overall tract, but since the <br />Thanksgiving storm, staff has been making more recommendations <br />regarding setting back further from the ocean and taking <br />additional measures to make sure -that no erosion damage occurs. <br />Attorney Brandenburg explained that one of the reasons for <br />the County's resolution to put a hold on development reviews <br />until the ordinance can be considered was that the County just <br />does not have the necessary information to determine how these <br />projects are going to impact the traffic system on the barrier <br />'island now or in the long run. If this project were allowed to <br />go ahead because it was submitted prior to that date, as opposed <br />to all the rest that were submitted after that date, there has to <br />be a distinction based on the policy behind the resolution, and <br />he was having trouble finding that distinction. <br />Attorney Caldwell believed that the purpose of the <br />resolution was to stop the influx of site plans, but Attorney <br />Brandenburg reiterated that the Board's purpose was to make sure <br />they had the necessary knowledge in hand before they made <br />decisions on planning & zoning matters so that they did not <br />jeopardize the transportation system on the island in the long <br />run. <br />Attorney Caldwell stated that the legal position of the <br />owner is that the County does not have the right to stop them <br />just because a decision has been made to put in a moratorium. He <br />felt that the reason the moratorium was put into effect initially <br />was to placate the State even though the County felt the <br />densities for the barrier island were workable. <br />Chairman Lyons stressed that the State has raised the red <br />flag as far as our traffic situation is concerned, and while we <br />might have felt comfortable with it six months ago, they have <br />50 <br />M <br />
