The applicant has agreed to dedicate $27,000 to the County's <br />"Park Development Fund" as a condition of final plat approval, <br />to meet this requirement. Once the $27,000 dedication is <br />submitted, the application will have met all applicable County <br />requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval to The Sanderling subdivision and authorize <br />the Chairman of the Board of County Commissioners to sign the <br />contract for the Construction of Required Improvements and <br />accept the irrevocable letter of credit, subject to the appli- <br />cant's dedicating $27,000 in lieu of dedicating a public beach <br />access easement. <br />Attorney Brandenburg commented that as the Board is aware, <br />individuals abutting the ocean or river have a choice of dedi- <br />cating a 15' wide public access easement from SR A -1-A to the <br />ocean or river or dedicating the fair market value of such an <br />easement. The applicant in this case has agreed to pay the <br />$27,000 appraised value of such an easement, but is doing so <br />under protest as set out in the following letters from both the <br />developer and his attorney: <br />MCGEE, COLLINS &.1sSOCIMES, INC. <br />REAL ESTATE INVESTMENTS . <br />Mr. Stan Boling <br />INDIAN RIVER COUNTY PLANNING & ZONING <br />1840 25th Street <br />Vero Beach, FL 32960 <br />RE: SANDERLING REVISED PRELIMINARY PLAN <br />Dear Stan: <br />December 11, 1984 <br />This letter will clarify our understanding that in lieu of <br />granting a 15' easement to the county the Sanderling <br />Development will donate, under protest, $27,000 to the <br />county for use in developing its parks. Please understand <br />that I am reserving the right to ask the county <br />commissioners to delete this requirement from the site plan <br />approval process due to the recent extreme conditions that <br />have been imposed on barrier island land owners and also <br />the fact that the county has purchased extensive amounts of <br />oceanfront land since this requirement was inacted. <br />I trust this letter will complete your files so that you <br />might submit our application on the 13th of December to the <br />Planning and Zoning Board. <br />Sincerely, <br />i ze.,.. <br />Thomas H.
