We do control this under our site plans, and the <br />Hutchinson Island Resource ,Management Committee felt that the <br />local government, being the principal respondent to site plans, <br />could best monitor this. <br />Commissioner Bird asked if this would affect developers and <br />involve a requirement that is not already in place; Director <br />Keating explained that it just is more stringent than what is in <br />place right now. <br />Public Works Director Davis reported that the DER is <br />developing specific standards and criteria, and after they come <br />out with their performance criteria, -we may want to change our <br />ordinance. Right now they simply state that you cannot degrade <br />the water quality in the receiving waters. <br />Attorney Paul agreed that is the rule, but it is quite vague <br />and doesn't set out criteria to meet it. It only applies to <br />projects where a DER permit is not otherwise required. Our local <br />ordinance would pick up the smaller projects. <br />Commissioner Wodtke asked if this applies to the county and <br />our road system, and Public Works Director Davis stated that it <br />does. <br />Commissioner Bowman had a question in regard to the wording <br />at the top of page 2 of the ordinance. She felt it would read <br />better and be more consistent with "by showing" if it said "by <br />providing" rather than "and provide." <br />Attorney Paull stated that as he read it, an applicant is <br />required "to demonstrate" and "to provide." He must demonstrate <br />he can comply and he must provide the DER documentation. <br />Commissioner Bowman felt this should be in two sentences. <br />The Chairman asked if anyone present wished to be heard. <br />There were none. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Bowman, the Board unanimously <br />closed the public hearing. <br />70 <br />
