Lengthy discussion ensued as to the language regarding the <br />capacity of the City plant. Administrator Wright felt the City <br />is very close to their 85% of capacity now, and Director Pinto <br />stressed that the City has told us they were fully committed now <br />- 100% - and that there was no capacity left for the county. <br />City Manager Little agreed that was correct. <br />Commissioner Scurlock felt, in that event, this is a moot <br />point and the sentence should be left out. <br />Director Pinto stated that he has no problem with saying we <br />will provide that capacity when we build the north or south <br />county plant. <br />Mayor Gregg stated that he would have no problem with the <br />County saying when or if they build the plant, but City Manager <br />Little felt it should still contain the additional language in <br />the present agreement, i.e., "when or if the County builds the <br />plant, or from any plants constructed by others in which the <br />County may have capacity rights" <br />In further discussion, it was agreed we are through Section <br />2, and the 85% figure is still in. <br />Administrator Wright agreed if the City is at 85%, they can <br />call for the capacity, and he felt we all recognize that the City <br />could call for it today. <br />Attorney Brandenburg.commented that the City may not annex <br />all the South Beach area and suggested the wording state "South <br />Beach or any portion thereof," and this was agreed upon. <br />Director Pinto believed another point that must be <br />understood is that the 250,000 gallons will not service the <br />entire south beach area, and if the City creates new service <br />areas and has new customers and we have to replace those capacity <br />units, these new people must pay the County's impact fee. <br />Attorney Brandenburg agreed, and noted that when Mr. Gregg <br />provides the service down there, he will want to charge the <br />City's impact fee.
