FEB 2 0 1985 BOOK <br />Director Pinto stated that the City can't do that. We are <br />giving them the capacity; they are not giving the capacity to The <br />Moorings, the County is doing it through the City plant. <br />Mayor Gregg did not think we have a problem on this, he <br />noted, however, that the City provided 600,000 gallons on 6th <br />Avenue and the County sold it, but he did not want to get into <br />that nor did anyone else. <br />MOTION WAS MADE BY COMMISSIONER SCURLOCK, SECONDED BY <br />COMMISSIONER BIRD, to approve the agreement as amended: <br />1) 48 months notice everywhere through the agreement; <br />2) If and when either a south or north county plant is built <br />or the County has capacity at someone else's plant <br />(anything east of 58th Avenue); <br />3) No gallonage amount to be included; <br />4) Also in paragraph 3 - South Beach or any portion thereof. <br />_- Commissioner Wodtke wished to be sure if additional service <br />is provided in South Beach by the City that they don't collect <br />plant capacity costs and later on we are going to have to replace <br />that at no expense. <br />Mayor Gregg did not feel that is a problem, but he could not <br />assure the Commission what a City Council five years from now <br />might do. <br />City Manager Little felt there are certain assurances; the <br />City has said they are not ever going to build a new plant nor <br />expand that one, and unless they do that, there is no legal basis <br />for calculating a plant impact charge because you don't have any <br />cost to calculate it on. <br />Discussion continued at length regarding impact fees, and <br />Director Pinto felt it should be understood if service is <br />rendered to anyone outside the existing franchises and we have to <br />supply replacement capacity, they are going to have to pay impact <br />fees to us. <br />Mayor Gregg asked how the City can go to The Moorings with <br />80 <br />
