new construction and say they don't have to pay impact fees, but <br />the development across the street does. <br />Director Pinto stated that's the problem, - the City could <br />run a line now without a franchise to service someone outside of <br />the existing service area of Hutchinson Utilities, and then we <br />would be supplying replacement capacity to the City for those <br />people. He emphasized that he is just saying that any new <br />customers coming on outside of the existing franchise areas <br />should have to pay impact fees to the county. They can hold them <br />in escrow until the date that we replace that capacity. Mr. <br />Pinto again stressed that we must make it clearly understood that <br />is what the policy will be; it cannot be a free ride. <br />City Manager Little believed Director Pinto is making a good <br />point, and everyone agreed you can't pay for plant capacity <br />twice. <br />City Attorney Vitunac suggested that if the City ever does <br />collect an impact fee from outside the present area, they would <br />pass that through to the County. <br />Director Pinto did not agree and stated that very simply any <br />areas that are served outside of existing service areas on the <br />South Beach will be required to pay impact fees to the County <br />when the County replaces the capacity. <br />Commissioner Scurlock -agreed and felt this is covered by our <br />impact fee ordinance. He believed it is on the record that we <br />are not giving away any free capacity in any plant. <br />City Manager Little. felt the subject Agreement is not quite <br />conclusive enough to deal with the legitimate point Director <br />Pinto is making, but he believed the City Attorney and County <br />Attorney could get the agreement to cover this very easily. <br />Chairman Lyons asked if Mayor Gregg agreed with that <br />philosophy, and Mayor Gregg explained that his understanding is <br />that we are talking right now of Hutchinson Utilities and the two <br />other present franchises, Smugglers Cove and the other south of <br />The Moorings, which are very small.
