FES' 71985 <br />y <br />BOOK 60 PAGE 10 <br />allocation provided by this Agreement through the City's <br />wastewater treatment facilities lapses. <br />3. This temporary service authorization shall lapse 18 <br />months after County has notified Customer of its intention to <br />cease the temporary allocation. Upon receipt of such notice, <br />Customer shall immediately begin the construction of a private <br />wastewater facility under applicable laws. To guarantee this <br />facility is constructed, Customer has, concurrently with this <br />Agreement, provided the County with a performance bond in the <br />amount of $75,000.00, or such other security as approved by the <br />County Attorney. The condition of this surety will state that in <br />the event the County gives notice of lapse of the temporary <br />allocation and Customer has not thereafter commenced construction <br />of a private wastewater facility or made other arrangements for <br />service within eight months, then County shall have the right to <br />call upon the bond and construct the facility on Customer's <br />property as shown on Customer's site plan. <br />4. Customer agrees and understands that the County <br />intends to ultimately construct a wastewater facility to service <br />the area. County is unsure of the timing, the extent or the <br />location of said plant at this time.
