7-7 <br />L ---.i <br />WASTEWATER SERVICE AGREEMENT <br />THIS AGREEMENT made this 27th day of February , <br />1985, by and between INDIAN RIVER COUNTY, a political subdivision <br />of the State of Florida, hereinafter referred to as "County," and <br />REHABILITATION HOSPITAL SERVICES, INC., a Florida corporation, <br />hereinafter referred to as "Customer." <br />W I T N E S S E T H <br />WHEREAS, the City of Vero Beach and County entered into <br />a temporary wastewater capacity transfer agreement on the 6th day <br />of July, 1984, transferring 100,000 gallons per day of wastewater <br />capacity from the South County Mainland wastewater service <br />territory to the County's Hospital Node; and <br />WHEREAS, Customer is constructing a Rehabilitation <br />Hospital on property within the Hospital Node in the water and <br />sewer service area of the County and is in need of sewer service; <br />and <br />WHEREAS, the County is not in a position, at this time, <br />to supply sewer service to Customer, and desires to prevent the <br />proliferation of private package wastewater treatment plants; and <br />WHEREAS, Customer and County desire that the City <br />service Customer with a limited amount of sewer service on a <br />temporary basis; and <br />WHEREAS, it is now the intention of the County to <br />formally authorize the use of a portion of the temporary <br />wastewater capacity, under the following terms and conditions: <br />The parties agree as follows; <br />1. It is understood between the parties that this is a <br />12,000 G/P/D temporary allocation of wastewater capacity, and <br />County does not represent that County, City or any other facility <br />will be available for Customer for permanent service to the site. <br />Consequently, County will require Customer to provide assurances <br />of its ability to construct and operate a private wastewater <br />facility, pursuant to applicable laws and ordinances. <br />2. Customer has site planned a wastewater treatment <br />plant and agrees to construct and operate the facility in <br />accordance with all applicable laws in the event the temporary <br />FEB 2 7 1985 BOOK 60 Pace 09 <br />
