ALTERNATIVES AND ANALYSIS: <br />This application has been reviewed by all of the appropriate <br />County departments. The final plat is in conformance with <br />the approved preliminary plat. The Public Works division <br />has inspected and approved all of the completed improvements <br />and has approved the dollar amounts proposed for contract <br />surety and held in escrow. The Utility Services division <br />has approved the water distribution system and has no <br />objection to final plat approval. The County Attorney's <br />office has approved all submitted documents, including the <br />contract to construct the remaining improvements and the <br />three -party cash escrow agreement, both subject to being <br />signed by the Chairman of the Board of County Commissioners. <br />The proposed subdivision is traversed by a 33' AT & T <br />easement, which contains the Orlando/West Palm Beach tele- <br />phone cable. South of the South Relief Canal, this cable <br />easement runs along the western side of Old Dixie Highway. <br />Sections of this easement lie within existing County <br />rights-of-way in other subdivisions such as Dixie Gardens <br />Unit 2, Dixie Heights, Vero Beach Highlands, and Florida <br />Ridge. The easement and cable lie within some of the road <br />right-of-way to be dedicated to the County upon final <br />approval of this plat (see attachment 3). Staff phone <br />conversations with AT & T personnel in Indian River County, <br />Orlando, and Atlanta have confirmed that AT & T staff <br />supervised all construction and paving work within the <br />easement, and that AT & T has no objection to the Oak Ridge <br />Subdivision project. County staff has sent a letter to AT & <br />T's Atlanta office, requesting written confirmation that AT <br />& T has no objections (see attachment 10). This will ensure <br />that AT & T will not have the ability to exercise its <br />easement rights contrary to the County's interests. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners <br />grant final plat approval to Oak Ridge Subdivision, accept <br />the submitted warranty maintenance agreement and irrevocable <br />letter of credit, and authorize the Chairman of the Board of <br />County Commissioners to sign the submitted Contract for <br />Construction of Required Improvements and three -party escrow <br />agreement. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously (4-0) <br />granted final plat approval to Oak Ridge Subdivision, <br />accepted the warranty maintenance agreement and <br />irrevocable letter of credit, and authorized the <br />Chairman to sign the Contract for Construction of <br />Required Improvements and three -party escrow <br />agreement. <br />SAID .DOCUMENTS ARE ON FILE IN THE OFFICE OF THE CLERK. <br />P] <br />WIAR 6 1985 Boor 6A k-cr, 50 <br />
