Stan Boling A(►j� REFERENCES: Courtside <br />Staff Planner • DIS:STAN <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of March 6, 1985. <br />DESCRIPTION AND CONDITIONS: <br />Courtside Subdivision is a twenty-nine lot subdivision located <br />on a ±18 acre site. The proposed development is located on the <br />north 'side of Rebel Road, east of 43rd Avenue. The subject <br />site is zoned R-1, Single -Family Residential (6.2 dwelling <br />units/acre ) and has a LD -1 (3 dwelling units/acre) land use <br />designation. The proposed building density is 1.6 dwelling <br />units/acre. <br />The applicant, Westside Partnership (Fred Tuerpe and Earl <br />Spytek), is requesting final plat approval. <br />ALTERNATIVES AND ANALYSIS: <br />Courtside Subdivision received preliminary plat approval from <br />the Planning and Zoning Commission on January 12, 1984. The <br />final plat is in conformance with the preliminary plat. <br />The subdivision will be served by individual wells and septic <br />tanks. All on-site construction has been completed and is in <br />conformance with the land development permit. The Public Works <br />Division has inspected and approved the construction of all the <br />required improvements. <br />The applicants have submitted a Warranty Maintenance Agreement, <br />committing them to guaranteeing against defect for 1 (one) year <br />the subdivision 'improvements dedicated to the County. The <br />applicants have also submitted an irrevocable letter of credit <br />for $13,743.82, representing 25% of the total cost of con- <br />struction of the covered improvements. This letter of credit <br />serves as surety to guarantee the Warranty Maintenance Agree- <br />ment; its amount has been approved by the Public Works <br />Division. Thus, the Courtside Subdivision final plat applica- <br />tion meets all applicable County regulations and requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval to Courtside Subdivision, and accept the <br />submitted Warranty Maintenance Agreement and surety for same, <br />in the form of an irrevocable letter of credit for $13,743.82. <br />10 <br />Lk <br />
