Keating, ICP <br />Planning & Development Director <br />Rev <br />FROM- Richard Shearer, AICP OEFERENCES: <br />' Chief, Long -Range Planni <br />POTEAT APPEAL OF THE <br />PLANNING & ZONING COM- <br />MISSION'S DENIAL OF HIS <br />REQUEST TO REZONE 20 <br />ACRES FROM A, AGRICUL- <br />TURAL DIST., TO C-1, <br />COMMERCIAL DISTRICT <br />ZC-101 Memo <br />CHIEF <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of March 6, 1985. <br />DESCRIPTION & CONDITIONS <br />Michael O'Haire, an agent for Willie Florence Poteat, the <br />owner, is appealing a November 8, 1984, decision by the <br />Planning and Zoning Commission to deny a request to rezone 20 <br />acres located 600 feet west of Kings Highway on the south side <br />of State Road 60 from A, Agricultural District, to C-1, <br />Commercial District. <br />On November 8, 1984, the Planning and Zoning Commission voted <br />4 -to -0 to deny this request for the following reasons: <br />1) They did not feel that the subject property could be <br />included in the Kings Highway/S.R.60 commercial node; <br />2) Commercial zoning should not extend indefinitely along <br />State Road 60; <br />3) The line between commercial and noncommercial zoning had <br />to be drawn somewhere. <br />On January 2, 1985, the Board of County Commissioners held a <br />public hearing to consider the appeal of the Planning and <br />Zoning Commission's decision. The Board agreed with the <br />Planning and Zoning Commission that, the subject property could <br />not be included in the node based on its 140 acre size limita- <br />tion. However, based on the existing zoning pattern in this <br />area with commercial zoning north and east of the subject <br />property, the Board felt that the subject property would be <br />suitable for commercial zoning. Based on this finding, the <br />Board instructed the. staff to initiate a Comprehensive Plan <br />Amendment request to enlarge the node to 160 acres. The Board <br />tabled the rezoning request until it was determined whether or <br />not the node would be enlarged. <br />On January 24, 1985, the Planning and Zoning Commission voted <br />4 -to -0 to recommend that the node at Kings Highway and State <br />Road 60 be enlarged from 140 acres to 160 acres. <br />ALTERNATIVES & ANALYSIS <br />In this section, <br />application will <br />description of the <br />surrounding areas, <br />utility systems, <br />environmental <br />an analysis of the reasonableness of the <br />be presented.
