MAR 13 1985, <br />BOOK <br />60 <br />1.43 <br />the northern part of the island. <br />He stressed that <br />the <br />property owners wish to participate in the transportation <br />analysis process and want to be notified of any meetings. <br />Administrator Wright announced that the traffic <br />analysis portion of the Barton-Ashmann report will be ready <br />for the April 16th meeting of the Transportation Planning <br />Committee. <br />Charles Regner, 1960 Pebble Path in Summerplace, stated <br />that everything that he has heard today seems to be in self <br />interest. He realized the County was interested in getting <br />taxes and people wanted to make profits on their property, <br />but it seemed to him that everyone is interested in just <br />themselves and not what is best for the island overall. <br />Attorney William Caldwell, speaking in behalf of the <br />developer of the Orchid Beach Club, suggested that an <br />expiration date for the moratorium be set before another tax <br />roll comes along in December. In addition, he believed <br />that what the Board is actually doing today is adopting the <br />traffic analysis part of the proposed ordinance. He <br />recalled that when he appeared before this Board last month <br />to argue the site plan of the -Orchid Beach Club, he had felt <br />that it was wrong that a developer should be stopped dead <br />after spending a great deal of effort and money in preparing <br />a full blown site plan. Attorney Caldwell again asked the <br />Board to either exempt them from the effect of the ordinance <br />or allow site plans that have been submitted prior to today <br />to proceed. He expressed concern that the site plan will be <br />subjected to further requirements by State laws such as <br />moving construction setback lines further back. He believed <br />that the moratorium resolutions were adopted without giving <br />adequate notice to the property owners involved and that, <br />according to case law, the moratorium should not go into <br />effect until the ordinance is adopted today. <br />20 <br />
