Attorney Brandenburg felt there has been ample case law <br />and other authority that gives the County Commission the <br />ability to delay a decision on a development until they can <br />obtain the necessary information to determine whether or not <br />that development is going to create hazards or hurt the <br />overall planning, transportation and basic welfare of the <br />community. He believed the Commission did exactly that when <br />it adopted the interim resolutions, and stated he would feel <br />very comfortable in litigating this matter. <br />Attorney Caldwell did not agree. He continued to argue <br />that the Orchid Beach Club site plan was a unique situation, <br />and that it should be allowed to proceed because it was the <br />only site plan up for approval just before the resolution <br />was adopted in November. <br />Chairman Lyons wondered whether the Orchid Beach Club <br />site plan should be argued separately, and Commissioner <br />Scurlock noted that it was not on today's Agenda. <br />Commissioner Wodtke felt that it is pertinent to <br />discuss the site plan today. <br />Attorney Brandenburg advised that if the ordinance is <br />adopted today, their site plan will be included in the <br />moratorium just like everybody else. <br />Chairman Scurlock recalled that the site plan had <br />already been discussed at some length last month and the <br />Commission had voted to include it in the moratorium. <br />Attorney Caldwell felt this was the time to discuss it <br />because if the moratorium ordinance was adopted today, it <br />would be included. He explained that the property is <br />located approximately 600 feet north of Summerplace - 25 <br />acres east of AIA and 5 acres west of AIA - and that this <br />area is the only multiple -family zoning in the county north <br />of Wabasso. <br />Director Keating stated that the applicant is proposing <br />a multi -family development with units clustered on the east <br />21 <br />MAR 13 1985 BOOK 60 FAGE144 <br />
