Attorney Brandenburg clarified that the Board said go <br />through that procedure so staff could determine what requirements <br />Mr. Powell could not meet and then allow him to apply for a <br />variance. <br />Commissioner Scurlock felt Mr. Powell should establish roads <br />for the area and that he should be required to do the appropriate <br />drainage. He continued that he personally could go along with <br />not having the actual paving, but felt strongly there should be <br />some kind of road available to all lots. <br />Commissioner Bowman inquired about utility easements, and <br />Attorney Brandenburg stated that if the subdivision was platted, <br />the plat would show all necessary utility easements and rights- <br />of-way. <br />The Chairman asked if anyone present wished to be heard. <br />David Rever of Carter Associates came before the Board <br />representing Mr. Powell. He informed the Board that as far as <br />the road is concerned, the right-of-way is there, but it has not <br />been improved because there was no need. All of the roads in <br />this area are unpaved. As far as the drainage is concerned, Mr. <br />Rever stated that he checked with the Soil'Conservation Service, <br />and they indicated that the soil on these lots, which are 1/2 <br />acre or larger, could accommodate that type of residential <br />drainage. Mr. Rever believed that the County Attorney pointed <br />out that this was done legally, and he stressed that the Minutes <br />show that the previous decision of the Board was to accept the <br />County Attorney's recommentation that the applicant come back <br />with the variance requests for waiver so he could plat the <br />property as indicated showing the necessary easements. <br />Commissioner Scurlock felt the Motion wanted staff to <br />specify what things we were going to allow him not to have to do <br />and then the decision was going to be made today whether or not <br />we wanted to waive all those requirements.
