-I <br />MAR 2 0 1995 BOOK 60 F,�,E212 <br />where people don't have a road to get to their property or where <br />they will be under water. <br />Commissioner Bird stated that the concern he has is whether <br />the platting will cover the easements that will be required. <br />Dan Powell, owner of the subject property, noted that when <br />he first bought the property in 1972, the County didn't maintain <br />4th Ave. SW because there were no homes there. As soon as there <br />were homes built, they did haul in marl and keep the road graded, <br />There are no homes on 16th St. S.W., and there's no road main- <br />tained down to the canal. <br />Commissioner Scurlock understood that, but explained that <br />what he is saying is that if you have a subdivision there, you <br />need to go ahead and extend that road and bring it up to the same <br />standard as the existing portion of the road and then provide for <br />drainage. <br />Mr. Powell noted that the drainage runs down to the canal. <br />Commissioner Scurlock stated that staff will tell him what <br />the drainage plan should be and what is acceptable and continued <br />that he did not want to be in the position of approving a waiver <br />and then having someone come before the Board a year from now <br />saying that he can't get to his house or that it is flooded. <br />Chairman Lyons concurred and noted that he actually doesn't <br />like the idea of waiving anything, but he felt there are some <br />unusual circumstances involved in this particular situation. <br />Director Davis pointed out that some owners have a double <br />, frontage on these roads, which may make it difficult in the <br />future to get a sufficient number of people to sign a paving <br />petition. He further noted that it has been our experience in <br />this area that as soon as we cut in drainage swales, the sand <br />ridge clogs up the drainage. Director Davis, therefore, recom- <br />mended that the developer be required to contribute a fair share <br />to fund 37h% of the cost of paving the roads so we do not end up <br />with a marl situation and have continuing drainage problems. <br />36 <br />
