Director Keating felt what the staff will have a difficult <br />time dealing with is when the next person comes in with unusual <br />circumstances and wants to get a variation. He supported the <br />Public Works Director's recommendation that the applicant be <br />required to pay his fair share of the paving and believed staff <br />needs some policy on this. <br />Commissioner Scurlock questioned about how much money this <br />would involve for Mr. Powell, and Director Davis believed about <br />$11,000. <br />Attorney Brandenburg felt some notation could be made on the <br />plat that should the County decide to do paving in that area, the <br />property owners would be required to pay their share. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Bowman, the Board unanimously <br />closed the public hearing. <br />Commissioner Bird asked if this situation arises often as he <br />did not remember many occasions over the last five years, and <br />Director Keating noted that since the new ordinance went into <br />effect about a year and a half ago, we have gotten much better at <br />catching people because of our link with the Property Appraiser. <br />Commissioner Bird did not believe the Board could give staff <br />specific guidelines for every case, and Commissioner Scurlock <br />felt that is what the ordinance does. <br />Commissioner Wodtke pointed out that in this particular <br />_ case, the people came in, and checked with the County Attorney, <br />were told they could do something, and now we tell them they <br />can't do it. He certainly hoped we don't have any more such <br />situations. <br />Commissioner Scurlock agreed and stressed that he would hope <br />we don't point out loopholes in our ordinances any more. <br />Attorney Darrell Fennell came before the Board representing <br />Mr. Powell.
