APR 10 1985 <br />BOOK 60 PGE x+ 52 <br />All of the existing commercial uses and all of the commercial <br />zoning in the general area of the node are included in the node <br />boundary. The node boundary follows property boundary lines <br />except for a 36 acre parcel of land at the northwest corner of <br />Kings Highway and State Road 60 which is split by the boundary. <br />The south 20 acres of the property is Boned commercial and <br />included in the node but the agriculturally zoned north 16 <br />acres of the property, which is adjacent to a single-family <br />subdivision, is not included in the proposed node boundary. <br />RECOMMENDATION <br />Based on the above analysis, including the Planning and Zoning <br />Commission's recommendation, staff recommends approval of the <br />proposed boundaries of the Kings Highway and State Road 60 <br />commercial node. <br />Planner Richard Shearer explained that these boundaries <br />reflect 160 acres which follow property boundary lines in <br />all but one case. He stated that all of the property zoned <br />commercial in this area will be included in the node and all <br />of the property in the node will be zoned commercial except <br />for two properties. <br />Commissioner Scurlock believed that this squares it off <br />and makes it neat. <br />Chairman Lyons opened the Public Hearing and asked if <br />anyone wished to be heard. <br />George Heath, .Attorney representing A. J. and Helen <br />Brackins, owners of property at 5420 20th Street, referred <br />to the letter he wrote the Chairman and the Board requesting <br />that the Brackins property be rezoned from residential to <br />commercial. He believed the Brackins' property was a unique <br />situation and could almost be considered reverse spot <br />zoning. He cited the old Marcella property in the City of <br />Vero Beach that was finally rezoned commercial after being <br />in litigation for many years and didn't understand why his <br />clients' property should not be included in this commercial <br />zoning. <br />Commissioner Bird advised Attorney Heath that these <br />nodal boundaries are not set in stone as the Board has the <br />opportunity to amend the Comp Plan twice a year.
