APR 101985 <br />- BOOK 60 FA,E 5OS <br />Under discussion, Attorney O'Haire stated that he does <br />not have the authority to agree to the voluntarily fine and <br />stressed that this had not been a deliberate attempt to <br />evade the County's ordinances. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />passed unanimously. <br />Administrator Wright requested further instruction on <br />how to enforce these matters in the future and the Board <br />agreed that staff should proceed extremely vigorously and if <br />minor items are identified by the Planning Dept. not to be <br />in compliance, the applicant will post a bond equal to the <br />amount to accomplish those tasks. <br />Attorney Brandenburg recommended that language be <br />incorporated into the new site plan ordinance so that there <br />will not be any question as to what is minor. <br />Administrator Wright understood then that the Board is <br />saying not to issue any C.O.s unless the site plans are <br />completed and that the site plan ordinance is being prepared <br />and will come to the Board in 60 days. <br />Attorney O'Haire hoped that the Board is not saying to <br />staff that there is absolutely no room for administrative <br />discretion and reasonableness, and the Board assured him <br />that was not the case. <br />Commissioner Scurlock believed that the Board is saying <br />that the law is the law and must be followed until it is <br />changed. <br />COUNTY OBJECTION TO RESTAURANT DECK BEING BUILT OVER INDIAN <br />RIVER IN SEBASTIAN <br />Art Challacombe, Chief of Environmental Planning, <br />reviewed the following memo dated 3/29/85: <br />77 <br />11111111 <br />
