Chairman Lyons asked how we stand with the DER on our plans <br />for the west county plant, and Director Pinto reported that they <br />have issued permits for the construction of the collection and <br />transmission line. The project is out to bid and we should be <br />receiving bids the first week in May. The plant has been <br />designed and we have applied for a permit to build the plant and <br />they should be coming out with their comments on that any day <br />now. The higher echelon of the DER has been extremely <br />cooperative and likes the project very much, but getting through <br />to some of the lower echelon has been the problem. <br />Administrator Wright advised that the validation hearing is <br />scheduled for Monday and we should have the money to build the <br />line in 30 days, barring any complications. <br />Director Pinto noted that the situation is very much "GO" <br />and we should meet our dates. He would, however, like leave the <br />bids for the plant itself out a little longer, perhaps another 30 <br />days, in order to ensure more participation. <br />Attorney Brandenburg reviewed the following modifications: <br />Page 7, Section 2.2 - Term of Lease <br />This will be modified so that the lease runs for one year from <br />the date it is executed, plus it gives the County the additional <br />ability to extend it for 4 consecutive 3 -month periods. Page 8, <br />Section 2.3 - Rental Rate <br />The $160,000 figure is reduced to $100,000. Attorney Brandenburg <br />advised that "connection fee" is adequately defined. <br />Page 8, Section 2.4 - Payment of Rents <br />It states that the County provides the company with one year of <br />free service and then if we are present at the site during the <br />beginning or any part of the successive 3 -month periods, the <br />County must give them free service for the entire 3 -month period. <br />Commissioner Scurlock clarified that it is not really free <br />service -- it is service in lieu of rent.
