MAY 1 1985 BOOK 60 758 <br />the garbage pickup, but left the mowers, gasoline tanks, garden <br />maintenance equipment, etc. <br />Mr. Kahn submitted as Exhibit 1 a letter from 1982 stating <br />that all noises will cease; a letter dated 1984 advising that the <br />mowers will not be moved; a letter that the lawn mowing business <br />was illegal; citation from the Code Enforcement Board to cease <br />the operation or apply for a zoning change, altogether 8 units of <br />correspondence and 2 citations. He then introduced as Exhibit 2 <br />five sets of photos, plus memos, letters, plat, and hearing <br />excerpts to prove that R&R Enterprises falsely stated under oath <br />that they serve only Village Green with the equipment stored on <br />this property, and finally submitted as Exhibit 3 sets of <br />pictures showing the distances from his home to the compound and <br />the buffering lugustrum hedge, which does not keep out the noise, <br />conditions of the compound itself, and debris being taken to the <br />perc pond area. All of these Exhibits are on file in the Office <br />of the Clerk. <br />Mr. Kahn made a closing statement, summarizing the false <br />statements made; the disregarding of tenants' rights; the <br />violations of law; the continuing nuisance of loud and often <br />obscene language; and he emphasized that changing the Zoning Code <br />would simply condone the problem. Mr. Kahn stated that he has <br />$80,000 invested in his home and pleaded with the Board to deny <br />the request for a zoning change. <br />Commissioner Bird asked if the activities that presently <br />exist on that site still constitute a nuisance as he believed <br />they have been scaled down. <br />Mr. Kahn stated that they do have noise there in the <br />mornings when they come to work, as well as at noon and in the <br />evenings when they leave, and they also repair equipment in the <br />compound when the people are working elsewhere. <br />Commissioner Wodtke inquired if these are the people who <br />maintain the lawn at Village Green and the -ponds, lakes and <br />recreation areas, and Mr. Kahn confirmed that they are. <br />42 <br />0 <br />
