'MAY 1 <br />BOOK <br />Attorney Charles Sullivan, part owner of the subject <br />60 PAGF 772 <br />property, spoke for himself and Mr. LaFever. He stressed that if <br />this property is not rezoned to C-1, it simply will lie fallow as <br />it will not be used for multi -family. He did not believe any <br />site plan approval would allow 19 units, as stated by staff, and <br />felt they actually would be lucky to get nine or ten. Mr. <br />Sullivan emphasized the large amount of commercial all around <br />this area and reiterated his belief tha.t the Commission legally <br />would have to rezone as commercial the small triangle on the <br />southwest corner owned by Mr. Karst. He also felt that common <br />sense would dictate that this property be developed as a single <br />unit. Mr. Sullivan realized that at the last meeting staff was <br />instructed to do a study to determine how much more traffic would <br />result if this were rezoned commercial, and this caused some <br />expense, and he further realized that because the County paid for <br />the right-of-way, it was felt there should be some reimbursement. <br />He stated that he and Mr. LaFever, therefore, are willing to make <br />the following concessions: <br />1) they will give the County a deceleration lane on 6th Avenue; <br />2) they are willing to give a drainage ditch along the north <br />edge of their property to help solve the drainage problems of the <br />residents in that area; <br />3) they would be willing to make a $25,000 contribution to the <br />road fund; and <br />4) they would agree to erect some sort of buffer to the north - <br />either a concrete wall, a wood fence, or shrubs. <br />Mr. Sullivan agreed the road put through did help the land, <br />but •it helped the county also, and this is the maximum they can <br />do that they feel is reasonable. He further cautioned that if <br />this property is not rezoned, it will stay just like it is with <br />no drainage, no deceleration lane, no buffer and no $25,000 until <br />it either has a site plan or is condemned. Mr. Sullivan stressed <br />that this is the only piece of land like this on U.S.I, and it is <br />too valuable to be cut up in little pieces. <br />56 <br />_I <br />
