Keating, <br />Planning & Develox <br />DATE: <br />May 6, 1985 <br />SUBJECT: <br />AICPRM/( <br />,ent Director <br />FILE: <br />ADOPTION OF THE DRAFT <br />DECISIONMAKING AND <br />ADMINISTRATIVE BODIES <br />SECTION OF THE NEW <br />ZONING CODE <br />It is requested that the information presented herein be <br />given formal consideration by the Board of County Commission- <br />ers at their regular meeting of May 15, 1985. <br />DESCRIPTION & CONDITIONS <br />The Decisionmaking.and Administrative Bodies Section is a new <br />part of the County's zoning code. Although this section <br />incorporates various aspects of the present code, particular- <br />ly those aspects relating to the' Board of County Commission- <br />ers, the Board of Zoning Adjustment, variances, and rezon- <br />ings, this draft section is more detailed and comprehensive <br />than the criteria in the present code. <br />As written, this draft section of the code does not represent <br />significant changes to the structure or function of the <br />County's decisionmaking and administrative bodies. It does, <br />however, formally delineate the current responsibilities, <br />functions, composition, powers, and duties of the various <br />decisionmaking and administrative bodies. In addition, this <br />draft section of the new code establishes procedures for <br />rezonings, variances, and public hearings. Besides these <br />procedures, this section sets standards for review for <br />rezonings and variances. While not making substantive <br />changes, this draft section of the code does specify the <br />criteria to be used by the County's appointed boards in <br />making decisions; it specifically delineates accepted proce- <br />dures and time frames, and it modifies the rezoning process <br />to more closely correspond to state statutes. <br />On April 11, 1985, the Planning and Zoning Commission voted <br />4-0 to recommend that the Board of County Commissioners adopt <br />the proposed Decisionmaking and Administrative Bodies section <br />of the new zoning code, as amended. <br />ALTERNATIVES & ANALYSIS <br />In preparing this section of the code, the consultant an- <br />alyzed the County's existing ordinances, procedures, and <br />standards as well as considering various other alternatives. <br />Besides the consultant's work, the staff analyzed -the initial <br />draft and made various modifications. Finally, revisions <br />were made based upon a series of three public workshop <br />meetings held on this matter. Through this process, a <br />complete analysis addressing all viable alternatives for the <br />various procedures and standards was undertaken. The result <br />is a draft section of the new zoning code that will facili- <br />tate implementation of the code by formalizing the County's <br />decisionmaking and administrative criteria as it relates to <br />the zoning ordinance. <br />RECOMMENDATION <br />It is recommended that the Board of County Commissioners <br />adopt the proposed Decisionmaking and Administrative Bodies <br />Section of the new zoning code. <br />45 y <br />MAY 15 1985 BOOK 60 95)7 <br />
