MAY 15 1995 <br />BOOK <br />958 <br />Director Keating felt this was the least controversial <br />amendment of the code. The biggest change is that there is <br />specific criteria for zoning amendments, rezonings, variances, <br />administrative appeals, etc., as well as criteria for public <br />hearings and how decisions are made. He believed it is very <br />advantageous in that respect. Director Keating reported that <br />they made a few additions to the rezoning process; specifically, <br />one change is that a rezoning application would not be considered <br />active after one year if no work is done on it. They have put in <br />some specific language that if the rezoning sign posted is not <br />there for the entire time that is specified, it would not negate <br />the zoning itself. He believed those are the major changes <br />relating to rezonings and that most of the rest is pretty <br />self-explanatory. Director Keating informed the Board that the <br />Planning & Zoning Commission voted 4-0 to recommend adoption. <br />Chairman Lyons referred to Page 13 - Conduct of the Hearing. <br />He asked if there is any provision to indicate witnesses should <br />be sworn or whether that should be included. He just wanted to <br />be sure we are not prevented from.swearing witnesses if it is <br />desired. <br />Attorney Brandenburg stated that if the Board wants to have <br />a policy, then there should be a statement that all testimony <br />shall be sworn both at County Commission meetings and at the <br />Planning & Zoning Commission meetings. <br />Commissioner Scurlock felt it might not be a bad policy <br />since our decisions are based on the statements made. <br />Chairman Lyons did not feel it would be that cumbersome and <br />felt we could just ask everyone who wishes to be heard to stand <br />and be sworn at one time. He wished to know how the other Board <br />members felt. <br />Commissioner Bird felt this could be cumbersome if it were <br />done individually, and Mrs. Eggert, Chairman of the Planning 6 <br />Zoning Commission, stated that she would not mind swearing people <br />in collectively. <br />46 <br />
