Attorney Brandenburg felt it should just say that this area <br />must have the potential of having a dense population. <br />Commissioner Bird commented that he could anticipate someone <br />with one lot bringing in a Mom and Pop store, and then someone <br />later with four acres could -be stopped because the other one is <br />already there. <br />Commissioner Wodtke felt if someone came in with just one <br />lot, that staff would deny the request, and he would hope we have <br />the flexibility to say no in such a situation.. <br />Chairman Lyons noted that there seem to have been a lot of <br />questions raised and possibly we want to send this back to the <br />drawing board. <br />Attorney William Caldwell came before the Board representing <br />Dale Sorensen, Bill Becker, and Charles Bradshaw, who have filed <br />a petition to rezone six acres on the southwest corner of Route <br />60 and 74th Avenue. He informed the Board that they are in <br />support of what ACTS is after, but would like to see a larger <br />node permitted at this intersection and perhaps elsewhere in the <br />county along roads such as Route 60 and U.S.1, which certainly <br />are different than a road such as King's Highway, for instance. <br />In regard to measuring, Attorney Caldwell agreed there should be <br />some flexibility. He noted that his clients have applied for all <br />six acres, which in this new ordinance would preclude any of the <br />other of the four corners from getting any, and this goes back to <br />the first come, first served basis, which just is not fair. <br />Attorney Caldwell requested that the Commission give serious <br />consideration to increasing the size of nodes along SR 60 and <br />consider again the distance requirements. He noted that legisla- <br />tion is being considered whereby it is possible the County may <br />not be able to address Land Use Plan changes more than once a <br />year, and he did not feel the Board should have to rely on <br />changes of the Land Use Plan to make zoning decisions along the <br />major roads.
