DESCRIPTION & CONDITIONS <br />Adult Communities Total Services (ACTS), Inc., the owner, is <br />appealing the decision of the Planning and Zoning Commission to <br />deny their request to rezone 7.26 acres located north of State r <br />Road 60 and west of 74th Avenue (Range Line Road) from RM -8, <br />Multiple -Family Residential District (up to 8 units/acre), to <br />C-lA, Restricted Commercial District. <br />The applicant is requesting that this property be designated as <br />a neighborhood node. <br />On April 4, 1984, this property was rezoned from R-3, Multiple - <br />Dwelling District (up to 15 units/acre), to R -3A, Retirement <br />District. On April 11, 1985, the Board of County Commissioners <br />assigned this property to -the RM -8 Zoning District.. <br />On April 11, 1985, the Planning & Zoning Commission tabled <br />action on this request pending further staff analysis of the <br />criteria to be used in establishing neighborhood nodes. On <br />April 25, 1985, the Planning and Zoning Commission denied this <br />rezoning request. The Commission gave as their reason for <br />denial the fact that the subject property could not meet the <br />neighborhood node distance requirement, one criterion of the <br />neighborhood node Comprehensive Plan ammendment recommended by <br />the Planning and Zoning Commission for adoption. <br />ALTERNATIVES & ANALYSIS <br />In this section, an analysis of the reasonableness of the <br />application will be presented. The analysis will include a <br />description of the current and future land uses of the site and <br />surrounding areas, potential impacts on the transportation and <br />utility systems, and any significant adverse impacts on <br />environmental quality. <br />Existing Land Use Pattern <br />The subject property is vacant except for a sales office. <br />North and west of the subject property is land owned by ACTS <br />which is zoned RM -8 and has received site plan approval for a <br />total care facility. East of the subject property, across 74th <br />Avenue, is Village Green, a mobile home park zoned RMH-8, <br />Mobile Home Residential District (up to 8 units/acre). South <br />of the subject property, across State Road 60, is undeveloped <br />land zoned RM -6, Multiple -Family Residential District (up to 6 <br />units/acre). <br />Future Land Use Pattern <br />The Comprehensive Plan designates the subject property and all <br />of the land around it as MD -1, Medium -Density Residential 1 (up <br />to 8 units/acre). The applicant is proposing that the subject <br />-property be designated as a neighborhood commercial node. <br />Presently, the Comprehensive 'Plan describes neighborhood <br />commercial nodes as follows: <br />SPECIAL POLICIES REGULATING NODAL AREAS <br />1) Unspecified nodes may include: <br />Neighborhood Commercial Nodes - Neighborhood <br />commercial centers not less than two (2) acres nor in <br />excess of eight (8) acres per center.
