JUN 19 1985 BOOK 61 F,�GE 272 <br />Director Davis informed the Board that he has been <br />communicating with the owner of this park for about two years <br />now. What Mr. Hardee is asking is that the County provide water <br />and sewer to 24 lots, provide stub -outs, water mains, and pave <br />roads, which involves considerably more than the true value of <br />the property as reflected by the Property Appraiser. <br />Commissioner Scurlock emphasized that first and foremost, <br />there is no way the utility system can give free service or <br />extend service at no cost. He felt we should proceed with <br />condemnation. <br />Administrator Wright suggested that we make the same offer <br />to Mr. Hardee one more time before going to condemnation. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Bird, to authorize staff to once again <br />make the offer to Wellford Hardee, and if this effort <br />is unsuccessful to start condemnation procedures. <br />Commissioner Bird expressed some concern about comments in <br />Mr. Hardee's letter relating to losing his income stream and <br />having to move people. <br />Director Davis informed the Board that there is a difference <br />of opinion on this situation. The land the County is requesting <br />does not encroach any of the lots. Mr. Hardee's site plan shows <br />that the County has a 40' right-of-way when, in effect, we have a <br />30' right-of-way. In addition to the 401, Mr. Hardee's plan <br />shows a 20' buffer to the north. That equals 60' of space before <br />you get into his lots, and that is all we are requesting for <br />right-of-way, not anything included in his lots. The homes are <br />very close to the lot lines, but there will be about 20' from the <br />lot lines to the edge of the road. <br />Commissioner Bird believed that we have been more than <br />cooperative, and although he does not feel that Mr. Hardee has <br />been, he did not want to hand him a lawsuit on a silver platter. <br />24 <br />
