Attorney Brandenburg explained the quick -taking procedure <br />whereby the County has an appraisal and then escrows the amount <br />of the appraisal with the Clerk of Court; a short hearing is <br />then held with a judge; the judge awards us the land and hands <br />the money over to the owner, leaving open the question of what <br />was just compensation either to be settled at a later date or go <br />on to a jury trial. <br />Commissioner Bird inquired whether Mr. Hardee was aware that <br />this matter was to be on the agenda this morning, and staff <br />confirmed that he was. <br />Commissioner Wodtke stated that he would prefer to authorize <br />the Attorney just to proceed to issue the Order of Taking and <br />wished to know if this was similar to our condemnation process on <br />County Road 512. <br />Attorney Brandenburg explained that the quick -taking process <br />is different than the condemnation process followed on County <br />Road 512. <br />Commissioners Scurlock and Bowman agreed to reword their <br />Motion as follows: <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously author- <br />ized the County Attorney to issue the Order of <br />Taking for the right-of-way needed for Lindsey <br />Road from High Ridge Mobile Park owned by Wellford <br />Hardee. <br />Director Davis wished the Board to be aware that although <br />his memo stated that we have all the right-of-way needed for the <br />paving of Lindsey Road except the Hardee piece, actually there <br />are a few parcels east of the canal where we may have to clear up <br />title, but we have taken care of 950. <br />25 <br />BOOK FA'ue r. i J <br />q� <br />
