Brandenburg, REFERENCES: <br />County Attorney <br />The Indian River County Scenic Roads and Trails Committee, <br />after considerable debate and several drafts, recommends the <br />adoption of the attached Ordinance. <br />The County Attorney's Office now requests the Commission <br />review the Ordinance and determine whether to set the <br />Ordinance for public hearing for possible adoption. <br />Sincerely <br />Zan, <br />Ruth Stanbridge, Chairman of the Scenic Roads & Trails <br />Committee, advised that they had originally considered an <br />ordinance for Jungle Trail alone, but it evolved into a general <br />ordinance which would cover other roads in the County. <br />Attorney Brandenburg explained that if this ordinance is <br />adopted today, other roads could be added later on as it is still <br />up to the Board to decide whether or not a road should be paved. <br />Commissioner Bird understood that the proposed ordinance <br />mainly pertains to the area within the right-of-way and is <br />against encroachment by structures, above -ground utilities, etc. <br />etc. <br />Attorney Brandenburg confirmed that the erection of <br />structures within the protected area is prohibited.
